1. 1. General

   1.1. This agreement is between sole proprietor Artem Yuloskov, TIN 366227871296 (the "Administration"), and the user of pogzo.com and the Pogzo games (the "Platform").

   1.2. The user accepts this agreement when they start to use the Platform. If you do not agree with it, do not use the Platform.

2. 2. The Platform

   2.1. Pogzo is a set of games for streams. A streamer adds a game to the stream as an overlay, and the viewers play with chat messages.

   2.2. The Platform is given "as is". The Administration can change the games, and stop the Platform for a time or forever, with no notice.

3. 3. User obligations

   3.1. The user obeys the law and the rules of the streaming platform (TikTok, Twitch, YouTube and others).

   3.2. The streamer is responsible for the stream and its chat, also for the words that the viewers write in the game.

4. 4. Rights to the games

   4.1. The games, their design and their code belong to the Administration.

   4.2. A streamer can show the Pogzo games on streams and in recordings, also with monetization.

5. 5. Data

   5.1. To run a game, the Platform reads the public chat messages of the stream: the viewer name and the message text. The Platform can keep game statistics.

6. 6. Plans and payments

   6.1. This section is a public offer of the Administration (Article 437 of the Civil Code of the Russian Federation) for access to the paid plans of the Platform. The payment for a plan is the full and unconditional acceptance of the offer.

   6.2. The Platform gives a user 40 minutes of stream with the games for free each day. A paid plan gives more stream time. The plans, their prices and limits are on the page pogzo.com/en/pricing.

   6.3. The stream time is the time when the game of the user is open in a streaming program and the stream is live. The Platform counts it. The daily limit of a plan starts again at 00:00 Moscow time. When the limit is used up, the game does not work until the next day or until the user pays for another plan.

   6.4. A plan is paid for one month in advance in rubles through YooKassa (YooMoney LLC), with a bank card, SBP or another method on the payment page. The Platform does not get or keep the card data. The receipt comes to the email address of the user.

   6.5. A user with a card of a bank of another country can pay for a plan in US dollars at the price on the page pogzo.com/en/pricing. To do this, the user writes to the Administration in Telegram @yuloskov or at support@pogzo.com, and the Administration tells the payment method. Such a payment gives the plan for one month, with no automatic renewal.

   6.6. A plan starts to work immediately after the payment. The service is given remotely on the site pogzo.com.

   6.7. Each payment for a plan through YooKassa turns on the automatic renewal: the user tells the Administration to charge the price of the plan to the saved payment method each month at the end of the paid month. If a charge fails, the Administration tries two more times in the next two days. The plan works during that time.

   6.8. The user can cancel the subscription or unlink the payment method in the cabinet (the “Subscription” tab) at any time. The plan works until the end of the paid month, and no new charges come.

   6.9. When the user changes to another plan, the new plan works at once. The unused paid rest of the current plan is added to the new plan as days, by the ratio of the plan prices. A plan that the Administration gave as a gift is not added.

   6.10. The user can cancel a plan and ask for the money of the unused days of the paid month: write to support@pogzo.com or to Telegram @yuloskov. The Administration returns the money to the same payment method in 10 days after the request, as the Russian consumer protection law requires.

7. 7. Liability

   7.1. To the extent that the law permits, the Administration is not responsible for breaks in the Platform, for decisions of streaming platforms, or for losses of the user.

8. 8. Changes

   8.1. The Administration can change this agreement. A new version applies from the time it is on this page.

   8.2. The law of the Russian Federation applies to this agreement.
